H.R. 32 would grant any president broad authority to block federal funding for essential services that impact all members of our communities. 

If passed, H.R. 32 would: 

  • Allow the federal government to cut off funding for education, transportation, housing, food aid, public health, and crime prevention. The bill provides excessive discretion to federal officials, potentially halting critical programs like the National School Lunch Program, Meals on Wheels, and Head Start, as well as funding for FEMA disaster relief, soup kitchens, crisis counseling, emergency medical care, and more. 

  • Establish a vague and sweeping definition of "sanctuary jurisdiction," affecting as many as 700 communities in 32 states and D.C. H.R. 32 does not differentiate between jurisdictions that refuse cooperation and those that collaborate with federal immigration authorities while adhering to constitutional limits on detainer compliance. Additionally, control over jail operations varies widely across states, cities, and counties, meaning many local governments may be penalized for policies they do not directly control. 

  • Unconstitutionally coerce local governments to enforce federal immigration policies. The Supreme Court has repeatedly ruled under the Tenth Amendment the federal government cannot mandate states or localities administer or enforce federal regulatory programs. H.R. 32 violates this principle by coercing local governments into using their limited resources for federal immigration enforcement. 

We have already seen the consequences of executive overreach in recent attempts to freeze federal funding, creating unnecessary chaos and uncertainty. Now, H.R. 32 seeks to codify similar harmful policies, granting the executive branch unprecedented power to withhold critical resources from our communities.
